Board of Adjustment

The Board of Adjustment meets as needed in Town Hall.

DUTIES & RESPONSIBILITIES

We have two (2) alternate positions available for this Board. Anyone who is interested, please fill out the board member application on this page.

The board of adjustment shall meet only on an as needed basis when a property owner requests a variance to the Land Development Code or the Street and Road Improvement Code. They shall also hear and consider challenges to the administrative decisions by the town building official or town engineer. The quorum for the board of adjustment is four (4) members. The board of adjustment sits in a quasi-judicial position when considering variances to the Land Development Code. The board of adjustment shall have the authority to compel attendance of witnesses at hearings or meetings and to administer oaths. Any appeal of the decision of the board of adjustment shall be made through the circuit court and must be made within thirty (30) days of the finding by the BOA. The town council shall establish by resolution the appropriate application fee to be submitted.
